POS/Computer Systems: franchisee must purchase, maintain, and update software/computer/POS systems meeting franchisor specifications at franchisee's sole cost (estimated $3,000-$15,000 purchase; $1,500-$2,000 annual maintenance). POS system allows franchisor to communicate, poll, and review sales data, consumer trends, food/labor costs, and financial information. Franchisor has unrestricted access to all cash registers, computers, login information, and data; may obtain sales data directly from third-party delivery services (Uber Eats, Postmates, Eat24, Grubhub, Door Dash). Franchisor may introduce additional computer software/hardware which franchisee must purchase and maintain at own expense. Accounting/sales/reporting/records retention systems must conform to franchisor requirements. No contractual limitations on frequency or cost of upgrades/updates.
