Terms of Service

The Service is operated by FranReal LLC (“FranDeals”, “we”, “us”). You must be at least 18 years old and able to form a binding contract to use the Service. If you use the Service on behalf of a company or other entity, you represent that you are authorized to bind that entity to these Terms.

You are responsible for the information you provide, for keeping your login credentials secure, and for all activity that occurs under your account. Notify us promptly at support@franreal.com if you believe your account has been compromised. Accounts and access links are for the named subscriber and may not be shared, resold, or transferred without our consent.

Paid plans (including our Silver, Gold, and Apex tiers) are billed in advance on a recurring basis through our payment processor, Stripe. By subscribing, you authorize us to charge your payment method for the then-current fees and applicable taxes on each renewal until you cancel.

Subscriptions renew automatically for the same term unless you cancel before the renewal date. You may cancel at any time; cancellation takes effect at the end of the current billing period, and you retain access until then. Except where required by law, fees already paid are non-refundable and partial periods are not prorated. We may change plan pricing or features on prospective notice, effective at your next renewal.

You agree not to:

• scrape, crawl, bulk-download, or systematically extract the Service’s data except through features we expressly provide;
• resell, sublicense, or redistribute the data or reports to third parties, or build a competing dataset or product from them;
• use the Service to send spam or unlawful communications, or to violate any person’s privacy or rights;
• reverse engineer, interfere with, or attempt to gain unauthorized access to the Service or its systems; or
• use the Service in violation of any applicable law or regulation.

FranDeals aggregates and organizes franchise information, much of which is derived from publicly filed Franchise Disclosure Documents (“FDDs”), state registries, and other third-party and public sources. We work to keep this information accurate and current, but we do not warrant that any figure, score, ranking, or other data is complete, accurate, or up to date, and data may change or contain errors.

The Service is provided for informational and research purposes only. It is not legal, financial, investment, tax, or franchising advice, and is not a substitute for the official FDD or for advice from qualified professionals. Before making any franchise purchase or investment decision, you should review the franchisor’s current FDD and consult your own attorney, accountant, and other advisors. Brand names, logos, and trademarks referenced on the Service belong to their respective owners; their appearance does not imply any affiliation with, sponsorship by, or endorsement from those franchisors.

The Service, including its compilation, organization, scoring, software, and design, is owned by FranReal LLC and protected by intellectual-property laws. Subject to these Terms and your payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your own internal business or personal research use. All rights not expressly granted are reserved.

The Service relies on and may link to third-party services (for example, Stripe for payments and franchisors’ own websites). Your use of those services is governed by their terms, and we are not responsible for third-party content or services.

THE SERVICE AND ALL DATA ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FRANREAL LLC AND ITS OWNERS, OFFICERS, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOST PROFITS, REVENUES, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATING TO THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

You agree to indemnify and hold harmless FranReal LLC and its owners and personnel from any claims, damages, and expenses (including reasonable attorneys’ fees) arising out of your use of the Service, your content, or your breach of these Terms.

You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms or if we discontinue the Service. Provisions that by their nature should survive termination (including data disclaimers, IP, disclaimers, limitation of liability, and indemnification) will survive.

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

These Terms are governed by the laws of the State of Arizona, without regard to its conflict-of-laws rules. The state and federal courts located in Arizona will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service.
